Residential property is valued using only the market approach to value. In this approach, the value of the subject property is based on an analysis of comparable sales. For tax years 2025 and 2026, the comparable properties must have sold between January 1, 2023 and June 30, 2024. However, if insufficient data existed during that timeframe, data from each preceding six-month period (up to a period of five years preceding June 30, 2024) may be utilized.
Most non-residential property, including personal property, is valued by consideration of the market approach, the cost approach, and the income approach to value.

Senior Primary Residence Property Tax Reduction

SB24-111 Concerning a reduction in the valuation for assessment of qualified-senior primary residence real property. For property tax years commencing on or after January 1, 2025, the act creates a new subclass of residential real property called qualified-senior primary residence real property, which includes residential real property that as of the assessment date is used as the primary residence of an owner-occupier.

Distraint Warrant Tax Assessment Scam

An El Paso County property owner recently brought to our attention a letter she received. The letter has the ominous title “DISTRAINT WARRANT Tax Assessment Securities Public Judgment Records.” These letters stating a federal tax debt is owed are being sent throughout the nation. The fraudulent document threatens “SEIZURE OR FORFEITURE MAY BE IMMINENT DUE TO NON-PAYMENT OF TAXES” and states Social Security and bank accounts may be seized among other threats.

Concerning Property Tax and Making an Appropriation

SB24-233 Concerning property tax, and, in connection therewith, making an appropriation. Property tax revenue limit. Beginning with the 2025 property tax year, section 1 of the act establishes a limit on qualified property tax revenue, as defined by the act, for local governments (limit). This limit does not apply to local governments that are home rule municipalities, school districts, have not received voter approval to exceed the statutory 5.5% property tax revenue limitation, or have not received voter approval to collect, retain, and spend the majority of their property tax revenue without regard to the limitations in section 20 of article X of the state constitution. The limit is equal to the local governmental entity’s base year qualified property tax revenue increased by 5.5% for each year since the base year including the relevant property tax year. A local government may seek voter approval to waive the limit.

The Douglas Sheriff’s Department recently reached out to the Division of Real Estate,
requesting another advisory to be disseminated to the real estate community
regarding the persistence of vacant land scams. While these scams may also take
place in single-family homes and condominiums, they most commonly take place on
vacant, raw, or undeveloped land. Another common thread among these scams is that
the targeted property is not encumbered with a mortgage. Because these scams
continue to victimize brokers and the public, the Division would like to take time to
revisit this issue as it can happen everywhere in the state.
